The Real Estate (Regulation and Development) Act, 2016 gives homebuyers a dedicated forum for disputes with promoters. In Haryana, complaints relating to projects in Gurugram are heard by the Haryana Real Estate Regulatory Authority, Gurugram.
1. Identify the relief you need
Allottees commonly seek either a refund of the amount paid along with interest, or — if they wish to continue in the project — interest for every month of delay in handing over possession. Claims for compensation are dealt with by the Adjudicating Officer.
2. Gather the documents
- Allotment letter and builder-buyer agreement
- Payment receipts and bank statements
- Correspondence with the promoter, including demand letters
- Project registration details from the HRERA website
3. File the complaint
The complaint is filed in the prescribed form with the applicable fee, setting out the facts, the relief claimed and the supporting documents. The promoter is then issued notice and given an opportunity to reply.
4. Hearing and order
After hearing both sides, the Authority passes an order. Either party aggrieved by the order may appeal before the Haryana Real Estate Appellate Tribunal within the prescribed time.
5. Execution
If the promoter does not comply, the allottee can file for execution of the order. This step is often where persistence matters most.
