Gift Deed

Drafting and registration of gift deeds for transferring property to family members or others, without consideration.

A gift is the voluntary transfer of existing property without any payment in return. Under Sections 122 and 123 of the Transfer of Property Act, 1882, a gift of immovable property must be made by a registered instrument signed by the donor and attested by at least two witnesses, and must be accepted by the donee during the donor’s lifetime.

Once accepted, a gift generally cannot be revoked except in the limited situations the law allows, so the deed should be drafted with care — particularly where conditions, reserved rights or elderly donors are involved. Haryana provides stamp duty concessions for gifts between certain close relatives; the chambers checks whether a proposed gift qualifies and prepares the deed accordingly.

How we assist

  • Advice on a gift deed, a will or a relinquishment deed
  • Drafting of the gift deed and acceptance
  • Checking eligibility for the family stamp duty concession
  • Stamp duty, e-stamp and registration appointment
  • Execution before the Sub-Registrar with witnesses
  • Mutation in revenue / municipal records after registration

Documents usually required

  • Title documents of the property being gifted
  • Aadhaar and PAN of donor, donee and witnesses
  • Proof of relationship (for a family concession)
  • Passport-size photographs
  • Jamabandi / fard or property ID details, as applicable

The exact list depends on the property or business concerned; it is confirmed after the documents are reviewed.

Frequently asked questions

Only in limited cases — for example, where donor and donee agreed that it would be revoked on a specified event not depending on the donor’s will alone, or where it could be rescinded as a contract. A gift cannot otherwise be taken back at will, so the decision should be made carefully.

Yes. A gift of immovable property must be made by a registered instrument attested by at least two witnesses. An unregistered gift deed of immovable property does not transfer ownership.
